Overview of Mariner East Project
Mariner East 1 (completed)
The Mariner East 1 project involved repurposing an existing pipeline that previously carried products from the former oil refinery located at Marcus Hook in Delaware County, PA to markets in the west. The pipeline was refurbished, as the Mariner East Project, to carry 70,000 barrels daily of natural gas liquids (liquid propane and ethane) from Western Pennsylvania to Marcus Hook for both domestic distribution and export. Mariner East 1 utilizes mostly existing 8-inch diameter steel pipeline, except for a portion of the line, located in western Pennsylvania that was increased to 12-inch diameter steel pipe. The Mariner East 1 project was completed in late 2014 and is shipping both ethane and propane.
Mariner East 2
Sunoco Logistics is proposing to expand the existing Mariner East pipeline system through the construction of the Mariner East 2 (PA Pipeline Project) project. When constructed, this project will transport natural gas liquids from Ohio and the Pittsburgh area to the Marcus Hook facility for both domestic distribution and export. The Mariner East 2 pipeline, proposes approximately 350 miles of pipe, spanning Pennsylvania, West Virginia and Ohio. Mariner East 2 will have an initial capacity of approximately 275,000 barrels a day of natural gas liquids using a 20" diameter pipeline. The length of the project through Chester County is approximately 23.6 miles and in Delaware County, 11.4 miles. Approximately 80% of the Mariner East 2/PA Pipeline Project is to be located within existing right-of-ways.
On February 13, 2017, the PA DEP issued the necessary Chapter 105 (Water Obstruction and Encroachment) permits for each county the project will cross and the Chapter 102 (Erosion and Sediment Control) permits for each PA DEP region the project will cross. Construction began in late winter/early spring 2017 and the Mariner East 2 pipeline was put into service at the end of 2018. The second 16" pipeline, known as the ME2X, is being added to the Mariner East project easement. As of mid-2019, the Mariner East 2X line was still under construction.
With the commencement of construction, Sunoco has provided DEP with a 24 hotline number for the Pennsylvania Pipeline Project, also known as Mariner East II (ME2). This number is: 855-430-4491. This hotline allows for inquiries and concerns to be directed to Sunoco during construction. If there are concerns related to erosion and sedimentation and site restoration, residents can contact the Chester County Conservation District (CCCD) at 610-925-4920. If there are questions or concerns regarding stream or wetland crossings, residents can call DEP directly at 484-250-5900.

Sunoco periodically provides a community newsletter to assist residents in staying current with the construction status of the Mariner East 2 project. The newsletter provides updates, by segment, on the progress of the project. * The installation of proposed ME2 pipelines in West Whiteland Township, from Shoen Road to Lincoln Highway, were originally proposed to be installed via Horizontal Directional Drilling (HDD). Open trench construction method is now being considered with the exception of roadway crossings and other environmentally sensitive areas where the pipelines will be bored.

DEP to Receive Comments, Host Virtual Public Hearing on Mariner East 2 Pipeline Amendment Application, Chester County
On February 4, 2022, the PA DEP announced that they will receive public comments and host a virtual public hearing regarding a major permit amendment request from Sunoco Pipeline for work near Marsh Creek Lake. The public hearing and comment period are required under the terms of the Consent Order Agreement entered into between the DEP, the PA Department of Conservation and Natural Resources, and Sunoco Pipeline. The application is related to earth disturbances and temporary storage of dredged material to meet the requirements of the Marsh Creek Lake Impact Assessment and Restoration Plan. Wolf Administration requires Sunoco to restore Lake at Marsh Creek State Park
On December 6, 2021, DCNR and DEP announced that a settlement was reached with Sunoco Pipeline, LP, that will require dredging of Ranger Cove and restoration of natural resource damages at Marsh Creek State Park. Read the announcement.
PUC Directs Sunoco Pipeline to take public safety actions
On November 18, 2021, the PA PUC directed Sunoco Pipeline LP to take certain reasonable actions to protect public safety regarding the construction and operation of the Mariner East Pipelines, including ME1, ME2, and ME2X in a 3-0 Order based on a decision by Administrative Law Judge Elizabeth H. PA Charges Energy Transfer with Environmental Crimes
October 5, 2021, Pennsylvania files charges against Energy Transfer for environmental crimes related to the Mariner East pipeline project. PA Attorney General has filed 48 criminal charges against Energy Transfer related to the Mariner East project, most of which are related to the release of industrial waste at 22 sites in 11 counties across the state. US District Court files Memorandum of Law in Support of US DOT Motion to Dismiss Sunoco Exemption Request
September 24, 2021 the United States District Court for the District of Columbia filed a Memorandum of Law in support of the US Department of Transportation's Motion to Dismiss Sunoco's request to be held exempt from the Freedom of Information Act. The attorneys for the US Department of Transportation filed a motion for dismissal of Sunoco's request to be held exempt from the Freedom of Information Act, and require the government to redact safety information about pipeline ruptures, due to their inability to allege and prove that the government has violated some law other than the FOIA. April 9, 2021, PUC Rules in case brought by Chester County and Delaware County residents against Sunoco
PA PUC Administrative Law judge ruled on April 9, 2021 that Sunoco Pipeline violated state and federal law by failing to adequately communicate public safety risks of the Mariner East natural gas liquids pipelines, among other orders, including that the company expand its emergency notifications to include police departments and school districts, as well as share non-confidential inspection and testing reports with local officials. Sunoco was also ordered to meet with local stakeholders to develop additional emergency training and share emergency planning documents. The operator was also directed to conduct a depth of cover and distance between other pipelines and structures survey, and lower or bury the ME1 pipeline as appropriate, and provide adequate corrosion control where pipes are less than 12-inches apart.
Chester County Department of Facilities releases Geotechnical Impact and Sinkhole Risk Assessment Report for the Sunoco Mariner East 2 Pipeline at Chester County Library and Chester Valley Trail properties.
On February 1, 2021, the Chester County Department of Facilities released the Geotechnical Impact and Sinkhole Risk Assessment Report, which was an independent study of the county-owned properties of the Chester County Library and the Chester Valley Trail in West Whiteland Township. The risk assessment report, which was prepared by GeoStructures Geotechnical Engineering Consultants, is based on field exploration, USGS publications research, and the review of public records on the pipeline construction. The report identifies various karst features and weaknesses in the ground and rock at both properties in the vicinity of the pipeline and lists recommendations for geotechnical treatments. PA Environmental Hearing Board offers opinion on Sunoco Appeal
The Pennsylvania Environmental Hearing Board has issued an opinion on Sunoco's appeal of DEP's order in September, related to the inadvertent return in the area of Marsh Creek Lake. The judge issuing the opinion said that drilling cannot be resumed unless DEP approves an HDD restart report that Sunoco still has to submit for this area. This report requires an explanation of how drilling will resume and adequately protect public health and safety, as well as protect the environment. Read opinion here.
DEP Completes Review, Approves ME2 Permit Modification Requests for two sites in Chester County
On September 22, 2020, DEP announced that previously applied for permit amendments, addressing installation methodology, were approved for ME2 in Chester and Delaware Counties. The two locations in Chester County include a site near the PA Turnpike in Upper Uwchlan Township and a site near the Exton Bypass and AMTRAK and Norfolk Southern rail lines in West Whiteland Township.
PA DEP issues Administrative Order to Sunoco LP for violations of the Clean Streams Law and the Dam Safety and Encroachment Act
On September 11, 2020, PA DEP issued an Administrative Order to Sunoco LP, that immediately suspends all work authorized by their previous permitting until the PA DEP has issued written authorization to resume work, requires that Sunoco take the steps necessary to implement the reroute of HDD S-3-290 that was previously found to be technically feasible, and within 30 days of the Order, Sunoco is required to submit a report fully explaining how the August 10, 2020 inadvertent return occurred and how the August 11, 2020 subsidence event occurred. Further, Sunoco must address all impacts to waters of the Commonwealth that occurred, by restoring and remediating all impacted uses. Learn more.
PA DEP formally issued a Notice of Violations to the Clean Streams Law
On August 20, 2020, the PA DEP issued a formal Notice of Violation to violations to the Clean Streams Law by the Mariner East 2 project related to the inadvertent return of thousands of gallons of drilling solution that discharged into a wetland and unnamed tributaries of the Marsh Creek Reservoir. Chester County Commissioners send letters to Governor Wolf
On August 12, 2020 and August 18, 2020 the Chester County Commissioners sent letters to Governor Wolf requesting a suspension of construction, and subsequently the revocation of Sunoco's permits for the Mariner East project after the inadvertent return of thousands of gallons of drilling solution into a wetland and tributaries of Marsh Creek Lake.
PUC Launches investigation into sinkholes along Route 30 in West Whiteland
After reports of several instances of subsidence along the Sunoco Mariner East right-of-way in West Whiteland, the PA PUC issued a press release announcing an investigation involving engineers and experts from the Safety Division of the Bureau of Investigation and Enforcement. The first subsidence occurred on July 10, with additional incidents developing as the week progressed. Read the press release.
Chester and Delaware Counties send joint letter to PA DCED and the PA Health Dept. on Sunoco waivers
On April 11, 2020 the Chairs of both the Chester County Commissioners and Delaware County Council sent a letter to the PA Department of Community and Economic Development (DCED) and the PA Department of Health regarding the waivers that were issued to Energy Transfer, LP (ET). Officials expressed concerns that not only did ET apply directly to the Governor's office, which was not the protocol to apply for a waiver, but that non-compliant behavior (contrary to the CDC and OSHA guidelines) could trigger a COVID-19 hot spot which would further burden the health care system and impose risk to the community at large. East Goshen Township confirms no inadvertent return on Carriage Drive
East Goshen Township confirms that there was no inadvertent return of drilling mud along Carriage Drive on Friday, October 4. The township was informed that the contractor for Sunoco was washing down its mud machine at the Wellington site prior to removing it and some left the work site. East Goshen Public Works confirmed that no mud was found in the storm sewer system and the matter was reported to DEP. View the notice from East Goshen Township on their Sunoco Update page.
Chester County Commissioners send letter to Governor Wolf
On August 19, 2019 the Chester County Commissioners sent a letter to Governor Wolf which included a discussion of Mariner East and their request to meet with the Governor to discuss not only Mariner East, but other pipeline-related initiatives.

On August 21, 2019, the Chester County Commissioners instructed the Department of Emergency Services to oversee a comprehensive, independent, and scientific evaluation of all hazards and threats of the Mariner East pipeline. This evaluation will ensure that first responders in Chester County will have the most comprehensive emergency preparedness plans, should there be an incident with the Mariner East pipelines. Chester County District Attorney to open a criminal investigation into Mariner East pipeline
On December 19, 2018, the Chester County District Attorney Tom Hogan announced that his office has opened a criminal investigation into the construction of the Mariner East 1, 2, and 2x pipelines in Chester and Delaware County. The investigation includes the owners of the pipelines (Energy Transfer LP, Sunoco Logistics Partners, and related entities). View the press release.
Chester County Commissioners request assistance from PUC and PEMA regarding ME2
On December 11, 2018, the Chester County Board of Commissioners wrote to the Pennsylvania Public Utilities Commission and the Pennsylvania Emergency Management Agency requesting assistance from both agencies to review and provide observations of Sunoco's Hazard and Risk analysis, as well as to conduct a review of municipal and school emergency plans for those municipalities affected by the Mariner East 2 pipeline.
PUC Response to area school districts
On October 23, 2018, West Chester Area School District, Downingtown Area School District and Rose Tree Media School District sent a joint letter to the Manager of Gas Safety at the PA PUC requesting safety information and a safety assessment on the 12-inch Sunoco Pipeline.

DEP completes review, accepts permit modification Requests for ME2 in West Whiteland Township
On August 16, 2018, the Pennsylvania Department of Environmental Protection announced via press release that they had completed their review for permit modifications to Chapter 102 and Chapter 105 permits submitted by Sunoco Pipeline, specifically related to two sites in West Whiteland Township. Sunoco still needs approval from the PA PUC before construction can resume, after a shutdown of more than two months. PA PUC votes to restart ME2 construction in Chester County of Chester
On August 2, 2018, the Pennsylvania Public Utilities Commission voted to allow the restart of construction on the Mariner East 2 pipeline at eight locations in West Whiteland Township. Injunctions on four remaining sites are still continued, where necessary permits have not been issued. The PUC indicated that while these actions address emergency injunctions, the PUC Office of Administrative Law Judge has an initial prehearing conference scheduled for late-August to address a "broad complaint" and various procedural issues.

Sunoco Releases Fact Sheet Regarding Service Change of 12-inch Line
On July 19, 2018, Sunoco released a fact sheet regarding the planned change of service on a section of 12-inch refined products pipeline to address client demand for Mariner East 2. The segment is known as the Point Breeze to Montello line. A 60-day notification to the Pipeline Hazardous Materials Safety Administration has occurred, and the change in product and direction is planned to begin mid-August. PUC Judge's Decision on West Goshen Settlement Agreement
On July 19, 2018, PUC Administrative Law Judge Elizabeth Barnes issued her decision regarding whether Sunoco was acting in violation of the 2014 Settlement Agreement with West Goshen Township. Judge Barnes' decision was based on filings made in June by both West Goshen Township and Sunoco Pipeline.
DEP Reaches Agreement with Environmental Groups Over Mariner East 2 Permits
On July 27, 2018, PA DEP issued a press release indicating that they had reached an agreement with environmental groups, related to Mariner East 2 permits. The Clean Air Council, Mountain Watershed Association, and the Delaware Riverkeeper Network settled their appeal of 20 permits issued to Sunoco for the Mariner East 2 pipeline project. In the settlement DEP committed to continue to develop and implement procedures for environmental protection associated with the construction of natural gas pipelines in Pennsylvania in collaboration with the appellants.
County Commissioners Request PA PUC to uphold Mariner East Suspension

PUC Administrative Law Judge Suspends Mariner East 1 Service; Mariner East 2 Construction in West Whiteland Township
On May 21, 2018, a Pennsylvania Public Utilities Commission administrative law judge issued an emergency order to immediately suspend service on the Mariner East 1 line and construction of the Mariner East 2 line in West Whiteland Township. This order was issued in response to a complaint from State Senator Andy Dinniman regarding the safety of construction in West Whiteland Township. View Order
DEP Announces new grant funding for water quality improvements along the ME2 pipeline corridor
The Wolf Administration announced the creation of a new grant program to be funded by Sunoco’s $12.6M penalty for permit violations. Grants will be awarded for projects that will reduce or minimize pollution and protect clean water in the 85 municipalities that the pipeline corridor traverses. Those eligible to apply include the municipalities, county conservation districts, incorporated watershed associations, educational institutions and non-profit organizations located along the length of the Mariner East 2 pipeline route. The grant application round will open on May 7, 2018 and run for 45-days. Awardees will be announced in the summer of 2018. DEP to hold public hearing for ME2 drilling method changes in West Whiteland
On April 30, 2018, the Pennsylvania Department of Environmental Protection will hold a public hearing on two proposed changes to Sunoco's permit for the Mariner East 2 pipeline. The hearing will deal with Sunoco's request to change pipeline construction techniques at two drilling sites in West Whiteland Township. The hearing is scheduled for Monday, April 30 from 6:30 p.m. to 9:30 p.m. at E.N. Peirce Middle School located at 1314 Burke Road in West Chester. View the news article.
DEP Authorizes Restart of Mariner East 2 Construction
On February 8, 2018, the Pennsylvania Department of Environmental Protection reached an agreement to lift the January 3rd order that suspended construction activity. The Consent Order and Agreement included a civil penalty ($12.6M) and resolved violations that were outlined in the January order, in addition to those discovered in the course of the DEP review of the project.

DEP Suspends Mariner East 2 Construction Permits
On January 3, 2018, the Pennsylvania Department of Environmental Protection issued an order suspending all construction activities associated with the Sunoco Mariner East 2 project. This order was issued in response to a series of spills, unauthorized horizontal directional drilling, and other violations of state laws.
Construction on ME2 resumes after temporary suspension of activity
On August 9, 2017, the Pennsylvania Department of Environmental Protection reached an agreement with the Clean Air Council, Delaware Riverkeeper Network, and the Mountain Watershed Association, Inc. and Sunoco to resolve the temporary suspension of horizontal directional drilling (HDD) activity associated with construction of the Mariner East 2 pipeline (ME2). This decision followed a two-week suspension of the drilling in late July due to adverse impacts on private wells and inadvertent returns of drilling mud. Under the agreement, Sunoco must notify all landowners and water supply owners within 450 feet of future HDDs and provide additional opportunities for water testing for those owners. Sunoco will also reevaluate at least 63 areas across the state where HDD activity will take place. The reevaluations will include site specific geologic data for each location. PA DEP Approves PA Pipeline Project/Mariner East 2 Permits

Pa DEP Issues Technical Deficiency Letters for Sunoco Logistics' Mariner East 2 Project
On September 6, 2016, Pennsylvania DEP issued technical deficiency letters for the Sunoco Logistics Mariner East 2 Project (a.k.a. Pennsylvania Pipeline Project) in Chester and Delaware Counties. These letters outline the technical deficiencies found during the review of the Chapter 105 (Water Obstruction and Encroachment Permit) and the Chapter 102 (Erosion and Sediment Control General Permit (ESCGP-2) for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment Operations or Transmission Facilities, ESCGP-2) Notices of Intent. The reviews were performed by the PA DEP, with extensive input from both Chester County Conservation District and Delaware County Conservation District.

The PaDEP has begun its technical review of all Chapter 102 and 105 permit applications submitted by Sunoco Logistics for the Mariner East 2 project (now referred to as the Pennsylvania Pipeline Project). The project requires multiple permits from DEP including permits for earth disturbance of five acres or more and permits for proposed activities located in, along, across, or projecting into a watercourse, floodway or body of water including wetlands. Sunoco Logistics Integrity Management Programming Work to be Performed
March 8, 2016 - Landowners and municipalities have received notifications that there will be planned integrity work on the 12" pipeline corridor that runs from Elverson, Chester County to Glen Riddle, Delaware County. This pipeline corridor primarily utilizes the same corridor as the Mariner East 1 and planned Mariner East 2. As part of the integrity management program, inspections and evaluations have been underway identifying sections that will require a repair and /or replacement to ensure the long-term integrity of the pipeline. This work will be taking place over the next 6 to 8 months, and will begin with surveying along the line in late March or early April. If it is determined that a property will be directly affected by pipeline repairs and/or replacements, a representative from Sunoco Logistics will contact the owners of those properties. Landowners are asked to call 855-430-4491 with questions about the project or general inquiries.
Mariner East 2X Open Season
After completing Open Seasons for the Mariner East 2 system, Sunoco Logistics Partners are in the process of holding an Open Season for Mariner East 2X, which will be able to transport additional volumes of petroleum products, including natural gas liquids and condensate from processing facilities in Western Pennsylvania, West Virginia and Eastern Ohio, to the Marcus Hook Industrial Complex on the Delaware River. The Open Season is offering service for ethane, propane, butane, C3+, natural gas and condensate, depending on customer interest. View Notice
Delaware River Basin Commission Hearing for Mariner East 2
Sunoco Pipeline LP has applied to the Delaware River Basin Commission (DRBC) to approve the construction of the Mariner East 2 project (including one 20-inch diameter pipeline and one 16-inch pipeline) within the Delaware River Basin. Sunoco is requesting to withdraw water for dust control, pipeline cleaning, horizontal directional drilling, and hydrostatic testing. The total quantity of water they are estimating for these purposes totals 2.508 million gallons of water. View Draft Docket

Erosion and Sediment Control General Permit
On September 15, 2015, the Chester County Planning Commission provided comments to Sunoco and impacted municipalities regarding the Mariner East Project's Erosion and Sediment Control General Permit (ESCGP-2) application review. View Letter
Clean Air Council - Mariner East 2 Lawsuit
The Clean Air Council and the Law Offices of Pinnola and Bomstein filed a civil action against Sunoco Pipeline in the Philadelphia County Court of Common Pleas in late August. The lawsuit seeks to establish that Sunoco Pipeline is not a public utility and does not have the right of eminent domain for the proposed Mariner East 2 natural gas liquids project. The lawsuit claims that the Mariner East project would not serve any public need in Pennsylvania and that Sunoco Pipeline has not received the required regulatory authority for the Mariner East 2 pipeline. As such, the lawsuit claims that Sunoco Pipeline should not be allowed to use eminent domain to build the pipeline.

Sunoco Logistics Mariner East 2 Open House - June 29, 2015
On June 29, 2015, Sunoco will host open house at the Sykes Student Union Building, located at 110 W. Rosedale Avenue on the West Chester University campus. The purpose of the open house is to provide potentially impacted landowners and local officials the opportunity to learn more about the Mariner East 2 project, interact directly with officials from Sunoco Logistics and partnering companies on the project, and collect information materials such as maps and fact sheets.
This open house will be held from 5:30-8:30 and is intended to focus on the eastern half of the Chester County portion of the Mariner East 2 pipeline project, from West Whiteland Township through Westtown Township. Attendees will have a chance to ask questions and address concerns regarding the near and long-term Mariner East 2 project during an informational presentation. Presentations will be held from 6-7 pm and 7:15-8:15 pm.

West Goshen To Host Sunoco Pump Station Public Meeting
On Tuesday April 14, 2015, the West Goshen Board of Supervisors will host a public meeting at West Chester East High School. This public meeting concerns the ongoing legal dispute with Sunoco Logistics about the Boot Road Pumping Station. The meeting will start promptly at 6:30 and will end at 10:00 p.m. in the auditorium, and will include a presentation from the Township's pipeline safety expert, Accufacts, Inc. West Goshen Township held a public meeting on April 14, 2015 to discuss and vote on a proposed settlement agreement with Sunoco, regarding the Boot Road pumping station. The supervisors voted to table their decision until the May meeting, by a vote of 4-1.

Mariner East Pipeline Refill Notification
Sunoco Pipeline, L.P. completed their Line Filling Process on the Mariner East Pipeline. As anticipated, the line filling processes began on 12/19/14 at the Mark West facility in Washington County, PA, and took approximately 7 days to complete.
Joint Motion of PUC on Administrative Judges Initial Finding
On October 2, 2014, there was a Joint Motion of the PUC (Vice-Chairman Coleman and Commissioner Witmer) to dismiss all preliminary objections, reverse the Initial Decision, and return Sunoco's amended petitions to the Office of Administrative Law Judge for further proceedings. The Commissioners indicate that this proceeding asks the PUC to decide a very specific question - "whether enclosures (walls and a roof) that are built around and over a valve control or pump station should be exempt from municipal zoning regulation." Additionally, the Joint Motion indicates that based on various mergers dating back to the 1930s, Sunoco is both a "public utility" and a "public utility corporation." Read Joint Motion

PA Administrative Judges Initial Finding
On July 23, 2014, Pennsylvania PUC Administrative Judges issued an Initial Finding regarding the Mariner East project. Sunoco had previously filed petitions requesting the PUC to find that control valve stations and pump stations along their proposed pipeline were reasonably necessary for the convenience or welfare of the public. Approving this request would exempt the operator from local zoning ordinances, as the facilities would be considered public utility buildings. In this application to the PUC, Sunoco was not seeking a certificate of public convenience; authorization to build the Mariner East line; approval for siting or routing of the pipeline; or compliance with environmental or public safety requirements. The Administrative Judges' Initial Finding dismissed the petitions because the pipeline operator's proposed service is not a public utility services as defined by the Pennsylvania Municipalities Planning Code (MPC) as well as the Pennsylvania Business Corporation Law.
